 •OAKLAND — A man who broadsided an Oakland police car and later admitted to being the “commander” of a Bay Area prison gang was sentenced to 41 months in federal prison, court records show.

Mekivil Franklin, 49, was sentenced last week by federal Judge Haywood S. Gilliam Jr. for a gun possession charge stemming from the August 2018 police chase. Prosecutors say the chase reached 90 mph and ended when Franklin collided with a police car, injuring Franklin, his passenger and two officers. A gun was found at the crash site, next to where Franklin landed after being thrown from the car.

A defense sentencing memo also highlights Franklin’s tragic history, which includes a suicide attempt at the age of 6, as well as Franklin’s own 5-year-old son, Keonnu “Nunie” Franklin, being killed in a 2007 accidental shooting. Keonnu was visiting a family member when he found a gun that had not been properly secured; his uncle was later charged for leaving the gun in a place the young child could find it.

On Aug. 2, 2018, Oakland officers tried to pull over Franklin for driving with an expired registration, later noting that his car “matched the description” of a car suspected to be involved in a recent shooting, as well as a recent robbery spree, prosecutors said. He led police on a chase on Interstate 880, as well as city streets, before crashing into the police car at Ninth Avenue and East 12th Street, court records show.

Franklin was thrown from the car and seriously injured. A few days later at a hospital, police questioned Franklin about the crash.

“He told the officers that he is a street commander of the KUMI 415 prison gang, and he showed the officers a tattoo on his arm that reflects his allegiance to the gang,” Assistant U.S. Attorney Phillip Kopczynski wrote in a sentencing memo. “He said he is one of six people who ‘run’ the KUMI ‘organization.’ ”

When authorities questioned Franklin about why he had the pistol, he replied, “I just told you I’m the commander of a gang,” prosecutors said.

KUMI 415 is an African-American prison gang with members all over the Bay Area. It is considered an offshoot of the Black Guerrilla Family prison gang, was formed in Folsom State Prison in the 1980s and uses four fingers as a symbol. Unlike some prison gangs, it maintains a heavy presence outside of correctional facilities.

Prosecutors asked for a four-year term, arguing that “judging from the damage to Franklin’s car and the patrol vehicle, all those involved — Franklin, his passenger and the two officers — are fortunate that they were not more badly hurt or killed.”

Franklin’s attorney, assistant federal public defender Hanni Fakhoury, asked for a three-year term, noting Franklin has lived a life “no one would envy.” Fakhoury wrote that Franklin “never had a chance.” His stepbrother, Troy Thomas III, frequently abused Franklin as a child and once attempted to smash his head with a brick, Fakhoury wrote. Thomas was eventually convicted of murdering St. Mary’s College Professor John Alfred Dennis Jr. in 2008.

“(Franklin’s) adulthood has been consumed by drug addiction and the revolving door of prison,” Fakhoury wrote. “His future looks bleak unless something changes and Mr. Franklin turns his life around.”

At the same time, Fakhoury said, Franklin accepted responsibility in this case.

“There is no question that Mr. Franklin made a significant mistake in this case— compounded by the many mistakes he has made in the past — that requires punishment. Mr. Franklin is prepared to accept that punishment and knows he will be sent to federal prison,” Fakhoury wrote.

 •A prison gang[1][2] is an inmate organization that operates within a prison system. It has a corporate entity and exists into perpetuity. Its membership is restrictive, mutually exclusive, and often requires a lifetime commitment.[3] Prison officials and others in law enforcement use the euphemism "security threat group" (or "STG"). The purpose of this name is to remove any recognition or publicity that the term "gang" would connote when referring to people who have an interest in undermining the system.[4]

 •Before the rise of large, formal prison gangs, political scientists and researchers found that inmates had already organized around an understood "code" or set of norms. For example, political scientist Gresham Sykes in The Society of Captives, a study based on the New Jersey State Prison, claims that "conformity to, or deviation from, the inmate code is the major basis for classifying and describing the social relations of prisoners".[5] Prisoners achieved a social equilibrium around unwritten rules. The code may include an understanding of prison slang, or prison yard and dining hall territory based on gang membership, rank, race, ethnicity, religion, or crimes committed, or it could simply be loyalty between inmates and against guards. Sykes writes that an inmate may "bind himself to his fellow captives with ties of mutual aid, loyalty, affection, and respect, firmly standing in opposition to the officials."[5] Hostility between wardens and prisoners, restrained freedom, and, some argue, the lack of access to heterosexual relationships shaped prison culture's social, environmental and political dynamics.
